The iFind Loyalty Program – ‘iFind’ is operated by Ageless Brands Sdn Bhd (Co. No. 892849-T)
All members of iFind are bound by the following terms and conditions of the iFind Loyalty Program which terms and conditions, as amended from time to time, shall be governed by the laws of Malaysia and both the Members and the Company agree to submit to the exclusive jurisdiction of the courts of Malaysia.
“Account”: Primary Member’s Point record including those of the Supplementary Members.
“Card”: the iFind membership card
“Company” : Ageless Brands Sdn Bhd (Co. No. 892849-T)
“Gifts” : Goods and/or services offered to Member in exchange for sufficient or designated number of Points
“iFind” : the consumer rewards membership program operated by the Company
“Member”: Primary Cardholder
“Membership”: An arrangement by which a Member agrees to participate in the Program and receives Points by purchasing qualifying goods and services from Partners and so qualifies for Gifts under these Terms & Conditions.
“Partners” : Those companies (and/or other persons) who are still validly registered under the Program to supply or sell qualifying goods and services in respect of which Points will be credited to Members under the Program.
“Points”: The points rewarded to a Member for using the Card for valid transactions under the iFind Loyalty Program.
“Suppliers”: Means the provider or company/persons that are engaged by iFind to supply the Gifts.
Membership of iFind is free. Only individuals aged above 18 and above are eligible to be Members. Any individual desiring to become a Member must complete and submit an application form prepared by the Company and upon being admitted as a Member, shall be issued with a Card, free of charge, the use of which shall at all times be subject to the terms and conditions contained herein. The Card will not be activated for redemption if the details requested for in the said application form are incomplete, inaccurate, false or suspected to be inaccurate or false.
The Card is not a credit card or charge card and is non-transferable. The use of the Card is solely restricted to the person whom the Card is issued for and is for use in connection with the Program only. The Points earned, collected or accumulated have no cash or monetary value at all and cannot be exchanged for any cash.
Information that ‘Member’ provided on the registration form or through other communication with Company, and when member uses the Card or gives detail to collect Points or redeem Gifts, the Partner will record in its database the detail of the transaction on which those Points are collected or redeemed.
Lost, damaged or defective card must be reported immediately to iFind Customer Service Center at 03-2170 6352. If the Card is lost, the Company may at its discretion issue a replacement Card at a cost of RM 10 or equivalent to 1000 iFind points. If there is a damaged or defective Card attached, the Card replacement charges will be waived.
Upon notification of a loss of, damaged or defective Card, any points which were resident in the lost, damaged or defective Card may, at the Company’s absolute discretion, be credited to the replaced Card. Notwithstanding the above, the Company shall not be liable whatsoever for the loss of any accumulated points due to the loss, damaged or defective Card.
Member must notify the Company immediately of any change of address or of a lost or stolen Membership Card.
The Company has the absolutely discretion whether or not to accept an application for Membership or to terminate a Membership without having to assign any reason(s) whatsoever but which reasons could include, but not limited to, the following:
* Provided any misleading or false information or made any misrepresentations to the Company or to any Partner in connection with iFind; or
* Abuses any privilege accorded to the Member under the Program; or
* Engages in any fraudulent activities under the Program; or
* Breaches any of the terms and conditions herein.
Termination of Membership will result in the immediate forfeiture of all the remaining Points in the said Member’s Account with iFind.
A Member may at any time terminate his or her Membership by giving a prior written notice to the Company. If the membership account is closed, the Member’s right to redeem Points from that Account is lost immediately.
Points can only be transferred from one valid Account to another valid Account (Provided That both the Accounts are opened under the name or instruction of the Primary Member), upon the demise of a Primary Member, to his / her next of kin, with sufficient official documentary evidence submitted to the Company for its determination, whose decision shall be the final. The Company reserves the right to decline the transfer of Points at its sole and absolute discretion without having to assign any reason(s) whatsoever.
The Company reserves the right to send summary statement on the points or other promotional materials / literature to a Member at its own discretion.
Any tax or tax issue arising from a particular Member’s participation in the Program is the responsibility of that Member concerned.
The Company is strictly not liable under all or any of the following circumstances:-
* Any delay in replacing a Membership Card or for any
* Any unauthorized use of the Card, Program or Membership;
* Any failure of Member to notify a Partner that a transaction is a iFind Transaction;
* Any delay/failure of a Partner to notify the Company of the details of a transaction;
* Any unauthorized redemption of Points;
* Any unauthorized use of Points or unauthorized sales of Points;
* Any loss, theft or damage to any Gift in the course of delivery;
* Any Gift not being available or substituted by other alternative for any reason whatsoever;
* Any failure to notify Members of any changes in any of the terms and conditions herein, the Gift offered, identity of any Partners, qualifying goods and services and/or the number of Points which will be recorded for the purchase of qualifying goods and services;
* The suspension and/or termination of the Program;
* Any technical failure of system, including iFind’s website, Self-Service Phone System, mobile short-messaging service and/or any electronic devise used under or in relation to the Program or iFind system which may impede a Member’s transaction.
The Company provides the Program for Partners and each exclusion or limitation of liability in these Terms and Conditions, the same also applies to each of the Partners, their employees and agents. The Partners do not have any authority whatsoever, express or implied, to make any representation, warranty or statement on behalf of the Company.
The Company reserves the rights to amend any of the terms & conditions contained herein at any time and from time to time without prior any notice to be given to the Members.
The Company reserves the right to suspend or terminate the Program at any time without prior notice. The Company reserves the right to assign or sell the Program to another company whereby the Company will transfer all rights and obligations under these Terms without having to obtain any consent from the Members and has the right to disclose or transfer all information concerning the Members to the prospective purchaser or eventual new owner of the Company or the Program.
Points will be recorded in a Member’s Account for purchases by the Member of qualifying goods or services from a Partner subject always to the Company’s right to appoint selected Partner(s) to offer Points to only specified group of Members, as determined by the Company in its absolute discretion, as part of any promotional and incentive programs.
Any changes in Partners, Points issuance rate and offers may be made without prior notification to Members.
2 tiers point collection structure
A Member is only entitled to Points by having presented the relevant valid Card and notified the Partner before a particular transaction in respect of a qualifying goods or services is concluded.
If a purchase is made by or through internet/mail order, the Member shall be entitled the points by quoting the Membership number provided that his / her membership is still valid.
Members can refer to the Company’s at website at www.ifind.com.my to view the list of Partners, whose participation in the Program is still valid at that material time.
The Company may from time to time forward a Points Summary Statement to Member setting out the opening balance of the Points, Points recorded and deducted during the period and the closing balance of the Points. However, the Company reserves the right to withhold sending the physical copy of the Points Summary Statement for any of the following reasons:-
when member’s address is incorrect or incomplete or suspected to be so; or
when a statement is sent electronically (e-statement) to an email address registered as the Member’s email account in the Company record.
when Company encounters in its opinion, an abnormal transaction or transactions in Member’s Account.
Disputes arising over the Points Summary Statement must be notified to the Company within one month from the date of the relevant Statement. The Company will not entertain any dispute over the said statement or any Points rewarded by any particular company after the said company has ceased to be a Partner in the Program.
The following terms describe in detailed the Terms and Conditions that apply to Gifts in the form of Certificates and Vouchers.
The certificate/voucher is not refundable or exchangeable for cash.
The certificate/voucher is valid for use only at participating outlets as mentioned on the certificates/vouchers and only for the specific matters mentioned therein.
The certificate/voucher is valid for use until the date specified and subject to the Terms and Conditions herein. If the Certificate/voucher remains unused after date specified, the certificates/vouchers will lapse and will not be replaced.
iFind or participating outlets will not replace lost, tampered, damaged or expired certificate/voucher.
Cancellation of certificate/voucher will not be accepted to allow reinstatement of Points.
The holder of the certificate / voucher will have to bear the difference if the value of goods and/or services purchased exceeds the face value of certificate/voucher. If the amount purchased is less than the face value of the certificate/voucher, the difference thereof will not be paid to the holder of the said certificate / voucher and shall be deemed forfeited absolutely.
Issuance of dining, travel or hotel accommodation voucher does not and shall not be deemed to have constituted a reservation. The holder of the certificate/voucher is responsible for notifying and making all reservations on their own (subject to availability). The Company will not be held responsible for any outcome as a result of the holders’ participation in any activity.
The holder may be requested to present their new Identification Card/Passport, original certificate/voucher and the Card upon redemption at the selected participating outlets.
Only Original certificate/voucher will be accepted. Participating outlets will not accept damaged, defaced, tampered or photocopied certificate/voucher and the decision of the Company is final.
The participating outlet also reserves the right to decline the certificate/voucher if it is found to be forged, tampered, expired and the certificate/voucher details do not match the holder’s Identification Card/Passport.
This certificate/voucher may not be valid during promotions or special offers. As such, the holder is required to refer to the participating outlets during the stipulated period on the certificate/voucher validity.
The rules and regulations, policy(s) and terms and conditions of the participating outlets (which include reservation requirements, cancellation restrictions, warranties and limitations) shall also apply notwithstanding the Terms and Conditions herein.
Only the Member with sufficient Points is eligible to redeem, and he/she may do so using the various redemption methods implemented by iFind. Redemption orders once accepted by iFind cannot be revoked, cancelled, returned or exchanged, and the affected Points will not be reinstated. If redemption channels are specified for a Gift item, iFind reserves the right to decline redemption made through any other channels without any notification. iFind gives no representation or warranty with respect to any products and/or services featured in the E-Redemption or other channels of redemption. In particular, iFind gives no warranty with respect to the quality of the Gifts or their suitability for any purpose. However, Members may liaise directly with the Supplier according to the warranty awarded.
Certain Gifts, which are in the form of certificates/vouchers, are valid for use only at participating outlets or Suppliers as mentioned on the certificates/vouchers and only for the specific matters mentioned therein. The certificates/vouchers are valid for use until the date specified and subject to the Terms and Conditions (which includes booking requirements, cancellation restrictions, warranties and limitations of liability) therein. If certificates/vouchers remain unused after date specified, the certificates/vouchers will lapse and will not be replaced. Issuance of dining, travel or hotel accommodation voucher does not constitute a reservation. The entitled Member is responsible for notifying and making all reservations. iFind does not accept liability whatsoever (including negligence) with respect to the Gifts supplied or in connection with any Supplier’s refusal to accept certificates/vouchers issued by iFind for the purpose of redeeming Gifts. Any disputes’ arising from this is solely between the Member and Suppliers. Members are strongly advised to adhere to safety precautions and instructions when participating in outdoor activities, as iFind will not be held responsible for any outcome as a result of Members participation in the activity.
‘Express Redemption’ is a redemption facility using a combination of iFind Points and Cash at values fixed as published by iFind or its Suppliers. ‘Express Redemption’ allows the redemption of Gifts by utilizing specified values of iFind Points and paying the specified cash portion via money order, postal order, bank draft, cheque, credit cards (Visa & MasterCard), debit cards, online payment or any other payment modes, which may be introduced by iFind from time to time.
Refunds for unfulfilled redemption will be made directly to the Primary Member in the manner to be determined solely by iFind on a case to case basis.
In Store Redemption
Primary Members are required to be present during the redemption transaction at partners outlet and must produce their iFind Card to facilitate the transaction and for verification purposes. Members are advised to examine the Gifts upon redemption. Only modes of payment agreeable to the Suppliers are accepted. iFind shall not be responsible for the condition of the Gifts once redeemed. Members should notify the Suppliers and refer to the warranty for any disputes arising.
Other Redemption Channels
iFind may introduce other methods of redemption, which will be announced in their promotional literature from time to time.
Delivery of Gifts
iFind will endeavor to deliver the redeemed Gifts to Members within 2 to 4 weeks upon receiving the redemption request from the Member. Gifts will be posted or delivered (at iFind’s option), to the current address of the Member shown in iFind’s record or any other address as authorized by the Primary Member. iFind will not deliver to PO Box addresses and addresses outside Malaysia. Member/recipient of Gift(s) is obliged to present ID documentation to the delivery staff, failing which the delivery staff has the right to refuse delivery and will return the Gift item to iFind as unclaimed. Delivery of Gifts will be made to the address as specified by the Member, or to the occupants at the delivery address, and where such address is an office, to any office staff. Such acknowledgment shall be deemed to be the acknowledgment of the Member.
Members are advised to examine all pick-ups or delivered Gifts upon receipt. If a Member finds the Gift item faulty/damaged, he/she is requested to contact iFind’s Customer Services Centre within 14 days from receipt date. Any disputes after 3 days will not be entertained and Members will be required to liaise directly with the respective Suppliers according to the warranty information.
All Gifts delivered do not include installation cost – any installation cost incurred will be borne by Members.
iFind will impose a separate delivery or courier charges or, where appropriate, deduct a set number of Points to account for delivery charges under the following circumstances:
* Delivery to East Malaysia; or
* Re-delivery of Gifts that have been returned as a result of being unclaimed; or
* Re-delivery of Gifts that have been returned under the following circumstances i.e. incomplete address, PO Box addresses, non-Malaysian addresses, person has shifted, no such person or for any other failed delivery reasons; or
* Urgent delivery (less than 2 weeks from process date)
* Delivery of Gifts of any other redemption channels as introduced by iFind from time to time.
All Gifts are to be delivered by iFind. In the event a Gift was collected by the Member at Partner’s outlets, courier service outlets or iFind office, iFind will not refund any delivery charges nor reinstate Points that have been deducted for delivery.
All Gifts unclaimed after 2 months from the redemption date will be deemed as forfeited. Points used will not be reinstated. It is the Primary Member’s responsibility to contact iFind if the Gift item has not been received after 1 month from request.
All Gifts are subject to availability. Once redeemed, these Gifts cannot be revoked, cancelled, returned or exchanged, and Points will not be reinstated. iFind reserves the right to adjust the Points required for redemption of Gifts, as well as replacing any Gifts with other item of approximate equivalent value without prior notice. iFind reserves the right to refuse the redemption of any Gifts or recall the redeemed item if iFind has any reason to suspect the Points were fraudulently accumulated by the Member or wrongly recorded.
All Gifts are subject to such Terms and Conditions as are mentioned in the current Gifts schedule or in any other Terms and Conditions relating to the Gift, as determined by the Suppliers, including any ticket for airline travel. It is the Member’s responsibility to satisfy any Terms and Conditions imposed by an airline or other Suppliers including advance booking requirements and any restrictions and/or fees payable in respect of the cancellation or alteration of tickets.
The number of Points published for a Gift claimed by a Member will be deducted from the Points balance of the Member’s Account, with the oldest Points being deducted first.
The Company may also deduct from the Points Balance in a Member’s Account under any of the following circumstances without having to notify the said Member in advance:-
Points suspect to be fraudulently or mistakenly recorded or obtained; or
Any Points which are erroneously awarded due to system glitches or other reasons in the absolute discretion of the Company; or
Any Points derived from any transaction which has been cancelled, voided, refunded or reversed.
